2. Booking and Payment Terms

• Booking Confirmation: All bookings will be confirmed in writing via email. It is the client’s responsibility to review the booking details and inform us of any discrepancies.
• Payment: A deposit of 50% of the total booking cost is required to secure a reservation. Full payment must be made at least 30 days before the scheduled departure or service date.
• Payment Methods: We accept payments via bank transfer, credit cards, and other available payment gateways.
• Failure to Pay: If the full payment is not received by the due date, Msafiri Space Ltd. reserves the right to cancel the booking without further notice, and the deposit may be forfeited.

3. Cancellation and Refund Policy

4. Accommodation and Travel Logistics

• Accommodation: We partner with third-party accommodation providers, and while we strive to offer high-quality options, Msafiri Space Ltd. is not responsible for any dissatisfaction arising from accommodation services. Clients are advised to review the specific accommodation policies before booking.
• Travel Logistics: We assist in arranging transportation and other travel logistics such as airport transfers and local transport. However, we are not liable for delays, cancellations, or issues arising from third-party service providers.

5. Personal Concierge Services

Msafiri Space Ltd. offers personal concierge services at an additional fee. These services include but are not limited to:

• Restaurant reservations
• Event tickets
• Special experiences (e.g., private tours, spa bookings) These services must be requested at least 72 hours in advance, and additional charges may apply depending on availability and complexity.

6. Tour Packages

• Itineraries: Our tour packages cover cities, national parks, and coastal beach destinations. While we do our best to adhere to published itineraries, changes may occur due to weather conditions, park regulations, or other unforeseen circumstances. Msafiri Space Ltd. reserves the right to modify the itinerary as necessary.
• Tour Guides: For most of our tours, professional tour guides are included. The guides are responsible for ensuring a smooth and enjoyable experience, but clients are expected to follow safety guidelines and instructions provided by the guides.

7. Client Responsibilities

• Travel Documentation: It is the responsibility of the client to ensure that they have the necessary documentation (e.g., passport, visas, permits) to travel.
• Health and Safety: Clients must disclose any medical conditions that may affect their participation in the tour. Msafiri Space Ltd. is not responsible for any incidents arising from undisclosed conditions.
• Insurance: We strongly recommend that clients obtain comprehensive travel insurance, including coverage for cancellations, health emergencies, and lost belongings.

8. Liability and Limitations

• Force Majeure: Msafiri Space Ltd. is not liable for delays, changes, or cancellations due to circumstances beyond our control, including natural disasters, political unrest, or pandemics.
• Third-Party Services: We act as agents in making arrangements with third-party service providers (e.g., airlines, hotels, transport services). Msafiri Space Ltd. shall not be liable for any act or omission by these providers.
• Limitation of Liability: Our liability is limited to the total cost of the booked services. Msafiri Space Ltd. will not be liable for any indirect or consequential losses, including but not limited to loss of enjoyment, personal injury, or financial loss.

9. Changes to the Terms and Conditions

Msafiri Space Ltd. reserves the right to update or modify these terms and conditions at any time. Changes will be effective upon posting on our website. Clients are encouraged to review these terms periodically.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Kenya.
